PDC Energy Wildlife Mitigation Plan and Agreement (Currently Caerus Piceance LLC [Caerus])

BACKGROUND
K was contracted by PDC to assist in developing the Piceance Basin WMP and agreement upon completion of the Marathon WMP agreement. The process required negotiating the methodology for mitigation and the mitigation cost with the CPW. This project consisted of mapping Piceance Basin existing and proposed pads to SWH for the GrSG. In 2010 PDC and the CPW entered into a formal WMP agreement, which mitigated for direct and indirect impacts to GrSG SWH for oil and gas operations within the Piceance Basin. In 2013 Caerus acquired the Piceance Basin lease hold from PDC, which included the agreement. CK handled the transfer of the WMP agreement and subsequent annual surveys as part of the WMP agreement as a third party review. The annual surveys review multiple pads for BMP compliance as listed in the WMP agreement, which requires annual report submittals to CPW. Caerus also acquired Noble assets in 2014. Noble obtained a separate WMP agreement (2010) that included Noble South Grand Valley, Battlement Mesa, and Rulison areas. CK provided the review and management to move the Noble WMP agreement to Caerus and made an addendum to Caerus’ existing WMP agreement by a letter in 2015. Both WMP agreements will consist as one overall WMP, which will be renewed in 2016 following the renewal date of the initial 2010 PDC WMP agreement. This project as others required GIS data acquisition for habitats, species, client asset boundaries, wildlife buffers, table top analysis, field surveys as needed, regulatory knowledge, agency interaction and negotiations, methodology to derive mitigation cost and other.
